Overseas Test House Recognition for Telecommunication Devices Certification

January 27th 2021, Directorate General of Post and Information Technology (SDPPI) issued a new decree with number 11, of 2021. This decree is a legal basis of overseas test house recognition practice for doing telecommunication equipment certification.

As we know, the last SDPPI decree that also regulated the similar topic, which is decree number 124, was expired on January 22nd 2021. So, this new SDPPI decree is basically to extend the previous one.

There are 9 main articles mentioned on this (SDPPI) Decree Number 11 Of 2021, as stated below:

F IRST: Determine testing laboratories for telecommunication equipment:

a. cellular telephones, handheld computers, and tablet, as stated in Attachment I which is an integral part of this Decree of the Director General; and
b. other than cellular telephones, handheld computers, and tablet as listed in Attachment II which is an integral part of this Decree of the Director General, as an Overseas Test Center recognized in the process of certifying telecommunication tools and / or equipment in accordance with the provisions of laws and regulations.

SECOND: The recognition of the Overseas Test House as meant in the FIRST Dictum is determined based on the fulfillment of the following criteria:

a. has the ability to test telecommunication tools and / or equipment according to the technical requirements stipulated in Indonesia or its equivalent;
b. has an accreditation certificate as a testing laboratory based on ISO / IEC 17025 accredited by the Accreditation Agency signing the Asia Pacific Accreditation Cooperation – Mutual Recognition Agreement (APAC-MRA) and / or the International Laboratory Accreditation Cooperation-Mutual Recognition Arrangement (ILAC-MRA);
c. has at least 2 (two) evidence of accreditation and / or recognition from international agencies or telecommunications regulators in other countries; and
d. has a person in charge by including the following data:

  1. the name of the person in charge;
  2. telephone number; and
  3. email address.

THIRD: For the purpose of certifying telecommunication tools and / or equipment, the Overseas Test Center as referred to in the FIRST Dictum, shall:

a. conduct tests according to the technical requirements of the telecommunication tools and / or equipment applicable in Indonesia;
b. attaches a summary of reference page of the Test Report related to the technical requirements applied in Indonesia.
c. using a digital signature on the Test Report published as of April 1, 2021; and
d. provide a guarantee in the form of a statement letter submitted to the Directorate General of Resources and Equipment of Post and Information Technology no later than April 1, 2021 via email testinglabs@postel.go.id which states that the personnel associated with the implementation of the telecommunication tool and / or equipment testing activities is independent and has no sides with the applicant / client whose products will be or is being tested, and does not allow conflicts of interest, commercial pressure, and / or other pressures that compromise taking sides with the implementation of testing services and the Test Report (LHU).

FOURTH: The Overseas Test Center as referred to in the FIRST Dictum shall report to the Director General of Resources and Equipment of Post and Information Technology in the event of any changes:

a. name of the Test Center;
b. place of domicile;
c. legal, business, organizational, or accreditation status; and / or
d. other matters which may affect the activity of testing telecommunication tools and / or equipment according to technical requirements and in accordance with the provisions of laws and regulations in the territory of the Republic of Indonesia.

FIFTH: The Directorate of Post and Information Technology Equipment Standardization evaluates the change report as referred to in the FOURTH Dictum.

SIXTH: In the event that based on the evaluation as referred to in FIFTH Dictum, the changes as referred to in the FOURTH Dictum are approved, the Directorate of Standardization of Post and Information Technology shall record the changes referred to in the database of the Overseas Test Center which is an integral part of this Decree.

SEVENTH: Recognition of the telecommunication tool and / or equipment testing laboratory as an Overseas Test Center as referred to in the FIRST Dictum is evaluated periodically every 6 (six) months and can be evaluated at any time based on need.

EIGHTH: The recognition of the Overseas Test Center as referred to in the FIRST Dictum can be revoked in the event that based on the results of the evaluation as referred to in the SEVENTH Dictum, the Overseas Test Center:

a. no longer meets the criteria as referred to in the SECOND Dictum; and / or
b. does not fulfill the obligations as referred to in the THIRD Dictum.

NINTH: This Decree of the Director General comes into force on January 22, 2021.

From regulation above, we can find 2 tables. Table one, page 7 – 9, is the list of recognized overseas testing labs for mobile phone, handheld computer, and tablet products. And table two, page 10 – 16, is the list of recognized testing labs for products except mobile phones, handheld computers, and tablets. It’s also stated that the this decree is valid for 6 months, from January 22nd 2021 to July 22nd 2021.
