PERMEN KOMINFO NO 2 TAHUN 2023: Updated Regulation of Radio Frequency Spectrum Usage Based on Class Permits

PERMEN KOMINFO NO 2 TAHUN 2023

PERMEN KOMINFO NO 2 TAHUN 2023 or Minister of Communication and Informatics Regulation Number 2 of 2023 was issued in Jakarta, March 21st 2023. This regulation is the updated version of PERMEN KOMINFO NO 1 TAHUN 2019 which mainly talks about the Use of Radio Frequency Spectrum Based on Class Permits.

The Use of Radio Frequency Spectrum Based on Class Permits has been regulated by Directorate of Standardization of Postal Equipment and Information Technology (SDPPI) since 2019 with the issuance of PERMEN KOMINFO NO 1 TAHUN 2019. After being valid for around 4 years, finally Ministry of Communication and Informatics (MoC) has withdrawn this regulation and updated it to the new one called PERMEN KOMINFO NO 2 TAHUN 2023. The Use of Radio Frequency Spectrum Based on Class Permits According to PERMEN KOMINFO NO 2 TAHUN 2023

Before talking further about PERMEN KOMINFO NO 2 TAHUN 2023, now let’s talk about the definition of “Class Permit” first. Article 1 paragraph 4 (Pasal 1 ayat 4) of PERMEN KOMINFO NO 2 TAHUN 2023 explains that Class Permit is a license to use Radio Frequency Spectrum which is attached to Telecommunications Equipment and/or Tools that has met Technical Standards and is used based on certain requirements. Or simply, we can understand that Class Permits is a license given to the to the citizens to freely use certain radio frequency bands mentioned in this PERMEN KOMINFO NO 2 TAHUN 2023 without the requirement of obtaining/buying frequency license or ISR.

However, the products that will use these frequency bands based on Class Permits are mandatory to comply with technical requirements by obtaining certification from Directorate of Standardization of Postal Equipment and Information Technology (SDPPI), as a proof that the device has complied to the applied technical requirements. Then, what technologies are granted class license based on PERMEN KOMINFO NO 2 TAHUN 2023? Here is the resume:

1.Radio LAN (RLAN)

RLAN stands for Radio Local Area Network. This is Telecommunications Equipment receiving and sending digital signals, which work on certain Radio Frequency Bands used for data transmission purposes, and are designed to allow IEEE standard interface compatibility 802.3, and is intended for wireless extended functionality.

Based on class permits regulation, RLAN includes: products with IEEE 802.11 (WLAN) standard and other standards referring to ITU-R M.1450 recommendations. In this classification, currently SDPPI already has technical regulation for WLAN, which is PERDIRJEN SDPPI NO 02 TAHUN 2019. However, current WLAN regulation only allows WLAN to operate in the frequency bands 2400 – 2483.5 MHz, 5150 – 5250 MHz, 5250 – 5350 MHz, and 5725 – 5825 MHz, while in this new PERMEN KOMINFO NO 2 TAHUN 2023, there is extra allocation for 57-64 GHz. Below is the table of RLAN allocation based on class permits.

2.Low Power Wide Area Network (LPWAN)

LPWAN is Telecommunications Equipment with low power consumption and wide coverage that works on certain Radio Frequency Bands. LPWAN includes non-cellular LPWAN and cellular LP-WAN. Current technical regulation of LPWAN is PERDIRJEN SDPPI NO 3 TAHUN 2019 about Low Power Wide Area. In this regulation, there’s allocation for cellular and non-cellular LPWA already. But, for non-cellular LPWA, there’s only one frequency band allocation which is 920 – 923 MHz. While in the new PERMEN KOMINFO NO 2 TAHUN 2023, there are several additional bands:

With the addition of new bands and requirements, we expect to see new LPWA technical regulations issued in the near future.

3.Short Range Device (SRD)

Short Range Device is Telecommunications Equipment that has a low risk of causing harmful interference. Based on the new new PERMEN KOMINFO NO 2 TAHUN 2023, SRD includes

  • a. Bluetooth IEEE 802.15.1;
  • b. Near Field Communication (NFC);
  • c. Radio Frequency Identification (RFID);
  • d. Ultra-Wide Band (UWB);
  • e. Low-Rate Wireless Personal Area Network (LR-WPAN) IEEE 802.15.4;
  • f. Cordless telephone;
  • g. Wireless Power Transmission (WPT);
  • h. Intelligent Transport System – ITS;
  • i. Telecommunication Tools and/Device with transmit power below 10 Mw, and j. Other SRD devices with technical standards stipulated in by Ministry

Current SRD regulation is PERDIRJEN SDPPI NO 161 TAHUN 2019, which covers some technologies namely Bluetooth, Low Power Device, Radio Frequency Identification (RFID), Near Field Communication (NFC), Wireless Personal Area Network (WPAN) IEEE 802.15.4, Intelligent Transport Systems, and other SRD devices. If we compare to the new SRD allocation on PERMEN KOMINFO NO 2 TAHUN 2023, we can expect some new technical regulations reference for Ultra-Wide Band (UWB), Cordless telephone, and Wireless Power Transmission (WPT).

Ultra-wide band technologies have been a question since long time ago, whether this technology is allowed by SDPPI. And now, with the issuance of this new regulation, we can see that technical regulation for UWB is under discussion and hopefully can be issued soon.

The same thing is also applied to WPT. Current practice of WPT certification is by putting it in the SRD classification for device operating between 16 – 150 kHz with max Tx Power 66 dBµA/m. With WPT being mentioned in the new regulation, we expect more ranges will be allocated for wireless power transfer technology. Next, finally we can see Cordless Telephone allocation again in the new regulation. Although this term is still too general, but we expect that this is related to Digital Enhanced Cordless Telecommunications (DECT). But we’re not really sure about this.

4.International Mobile Telecommunications based on Class permits

IMT are cellular mobile telecommunications equipment based on IMT technology standards by utilizing Class Permit Radio Frequency Bands combined with other Radio Frequency Bands that have been determined for the need for cellular mobile network operations. It includes Licensed Assisted Access (LAA); and IMT Based on class permit based on technical standard stipulated by Ministry.

5.Private Mobile Radio (PMR)

PMR is Telecommunications Equipment that works for short distance voice services that operate on predetermined radio frequency channels. This technology includes protofon and other standard according to technical standard stipulated by Ministry. Below is the allocation of PMR Technology.

With the issuance of this new PERMEN KOMINFO NO 2 TAHUN 2023, we see more opportunies ahead, especially on additional allocations for some technologies that was not allocated before. This means that the possibiliy of introducing new technology to Indonesia is opened even wider. However, please be informed that basically PERMEN KOMINFO NO 2 TAHUN 2023 is listing what kind of technologies, or what frequency bands are allowed to be used based on class license.
