Changes on Telecommunication Equipment Certification Process in SDPPI

As informed before, SDPPI just applied new regulation on telecommunication equipment certification, which is Communication and Informatics Ministry Regulation Number 7 year of 2018 (PM Kominfo No 7 Tahun 2018) about Electronically Integrated Business Licensing. In this new regulation, there are several major changes especially on the certification process. Below we inform you the changes that will affect on upcoming certification process.

1. Applicant

In regard to applicant, it’s already confirmed on Communication and Informatics Ministry Regulation Number 7 year of 2018 that the applicant have to be local company. Local company here can be defined as manufacturer, local distributor, local importer, or local representative of the company that’s officially registered in Indonesia. It’s stated in the section 59 about what it’s meant by applicant. They are:

a. Brand owner that is legally incorporated in Indonesia;
b. Indonesian business entity that’s designated as an authorized representative or distributor by foreign brand owner;
c. Indonesian legal entity that manufactures Telecommunication Equipment for brand owners domiciled outside the territory of the Republic of Indonesia;
d. Individuals or business entities that make, compile, and combine components of Telecommunication Equipment, so that they can function as Telecommunication Tools and / or Equipment.

Indeed, point 4 is not specifically mention company status, whether it is Indonesian company or foreign company. But still, due to the point 2 below, applicant needs to be local company.

2. Application Submission

Previously, submitting document application for the purpose of telecommunication equipment certification can be done through SDPPI website by logging in with applicant’s user account. But now, all licensing services, including telecommunication equipment certification, have been moved to Online Single Submission (OSS) system of Republic Indonesia. This system can be accessed by inputting applicant’s NIB number (Business License Number) and password. For your information, each company will have 1 NIB number, and this NIB is only applicable for local company, which why applicant needs to be local company only.

3. Certificate Validity

In the new regulation Number 7 year of 2018 section 70, it’s stated that:

a. Every telecommunication device that is manufactured, assembled, imported, traded or used in the territory of the Republic of Indonesia, it must be certified.
b. Telecommunications equipment that is still made, assembled, or imported to be traded in the territory of the Republic of Indonesia after 3 (three) years of certificate issuance date, it must be re-certified.

Referring to the regulation above and to SDPPI confirmation, it’s confirmed that there will be no renewal process. But, if after three years of certificate issuance the product is still manufactured, assembled, or imported, or traded in the territory of Republic of Indonesia, applicant needs to re-certify the product again. This re-certification process will be counted as new application, so the certificate number issued after re-certification process will be different with the first certificate number issued.

4. Certification Scheme
Due to the application of new certification system, the certification scheme is also changed. If in the past the flow of certification process is: “Submitting application documents and getting testing reference letter in SDPPI Headquarter >> do pretest and official test in SDPPI Lab >> evaluating test result and issuing certificate in SDPPI Headquarter>>Certificate issuance”, in the new certification scheme it will be different. Simple analogy for this new scheme is: “Proceed testing in SDPPI-accredited test Lab (Could be in-country SDPPI-accredited test lab or foreign SDPPI-accredited test Lab) to get the test report>>Submitting test report and application documents to SDPPI headquarter for evaluation >>Certificate issuance”.
